Terms and Conditions - The B Media Group LLC

1. Service Agreement

  • The B Media Group LLC agrees to provide video production, live streaming, and related audiovisual services as per the agreed-upon Scope of Work or Proposal. Services are subject to change based on client requirements, which must be communicated in writing 7 days prior to the event.

2. Payments and Late Fees

  • A 50% deposit is required upon signing to confirm the booking, which is non-refundable unless specified in the cancellation policy. The remaining 50% balance must be paid within 5 days after delivery of the final materials.

  • Late payments will incur:

    • A 5% late fee if the payment is delayed by 7 days or more after the due date.

    • An additional $25 per day if the payment is not made after the initial 7-day grace period.

  • Full payment is required within 30 days of the due date. Failure to do so will result in the pursuit of legal remedies.

3. Cancellation and Rescheduling

  • Cancellations:

    • More than 14 days before the event: 25% of the deposit will be refunded.

    • 7 to 14 days before the event: The deposit is non-refundable.

    • Less than 7 days before the event: Full payment of the service fee is required.

  • Rescheduling is permitted with at least 14 days’ notice, subject to availability and possible additional costs.

4. Extended On-Site Coverage

  • If the event exceeds the contracted time, additional hours can be requested on-site at least 30 minutes before the end time.

  • The additional hours will be billed as follows:

    • $100 - $150 per hour for social events.

    • $150 - $200 per hour for corporate events.

    • $200 - $250 per hour for complex events (e.g., sports coverage).

  • Additional hours will be invoiced within 5 business days and must be paid within 7 days after the event.

5. Force Majeure

  • The Service Provider is not liable for delays or cancellations due to force majeure events (e.g., natural disasters, power outages). Both parties will work together in good faith to reschedule or seek refunds.

6. Ownership and Usage of Materials

  • The Service Provider retains ownership of all video, audio, and other materials until full payment is received. After payment, the Client is granted non-exclusive rights to use the materials for personal or internal purposes.

  • Commercial use requires a separate licensing agreement.

7. Promotional Use of Materials

  • The Service Provider reserves the right to use materials for promotional purposes, unless the Client objects within 10 days after the event.

  • If the Client requests the removal of promotional materials in good faith, the Service Provider will comply.

8. Insurance and Liability for Equipment

  • The Client is responsible for ensuring a safe environment for the event and agrees to cover any damage to the Service Provider’s equipment caused by the Client, guests, or attendees.

9. Indemnification

  • The Client agrees to indemnify and hold The B Media Group LLC harmless from any third-party claims, including injuries, property damage, or intellectual property disputes.

10. Drone Footage and Permits

  • The Client is responsible for obtaining any necessary permits for filming, including the use of drones, which are subject to FAA regulations. If drones are used, they may incur additional fees.

11. Revisions

  • The Client is entitled to two rounds of revisions on the final product. Additional revisions will be charged at $100 per revision..

12. Governing Law

  • This Agreement is governed by the laws of the state of Texas, and any disputes will be resolved under Texas law.

1. What services does The B Media Group LLC provide?

We offer a range of audiovisual services, including:

  • Live event streaming for weddings, corporate events, and sports.

  • Video production, editing, and post-production.

  • Digitalization of events for corporate or personal use.

Additional custom services can be arranged upon request.

2. What is the deposit amount to confirm a booking?

A 50% deposit is required to confirm the booking. This deposit ensures your event is reserved in our calendar.

3. What if I need to cancel or reschedule my event?

  • If you cancel more than 14 days before the event, we will refund 25% of your deposit.

  • For cancellations made between 7 and 14 days, the deposit is non-refundable.

  • For cancellations with less than 7 days’ notice, the full service fee is required.

Rescheduling is possible with at least 14 days’ notice, subject to availability.

4. What happens if my event goes over the scheduled time?

You can extend on-site coverage at the following rates:

  • $100 - $150 per hour for social events.

  • $150 - $200 per hour for corporate events.

  • $200 - $250 per hour for complex events (e.g., sports).

Please notify us at least 30 minutes before the scheduled end time if you need additional coverage.

5. When do I need to pay the remaining balance?

The remaining 50% balance is due within 5 days after we deliver the final material. If the payment is delayed, a 5% late fee applies after 7 days, and an additional $25 per day will be charged after that.

6. Can I use the video or photos for commercial purposes?

No, commercial use of the materials requires a separate agreement and licensing fee. You are granted non-exclusive rights to use the materials for personal or internal purposes only.

7. Will you use footage from my event for promotional purposes?

We may use footage from your event for promotional purposes (social media, website, etc.), unless you notify us within 10 days after the event that you do not want us to do so. You can also request that we remove the footage at any time, and we will comply in good faith.

8. How long will it take to receive the final materials?

Final materials (videos, photos, etc.) will be delivered within 7 days after the event, unless additional editing or post-production is required. If you request revisions, the delivery timeline may be extended accordingly.

9. What if the event is delayed due to bad weather or unforeseen circumstances?

We are not responsible for delays due to force majeure events, such as natural disasters or power outages. In such cases, we will work with you to reschedule or provide a refund as appropriate.

10. Do I need to get permits for filming at my event?

Yes, the Client is responsible for obtaining any necessary permits for filming at the event venue, including permits for the use of drones, which are subject to FAA regulations. Failure to obtain permits may delay or cancel the event without a refund.
